Terms of Service

1. Acceptance of Terms

By accessing or using Mind Vision Guard ("Service"), available at guard.mindvision.com.ua, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Mind Vision Guard is a digital self-tracking and emotional journaling tool for traders. It allows users to log their psychological state, trading patterns, and behavioral observations. The Service is provided as a personal productivity tool only.

3. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent that you meet this requirement.

4. Account and Access

Access to the Service is provided via Telegram authentication. You are responsible for maintaining the security of your Telegram account. You agree not to share your access with others or use the Service in any automated, abusive, or unauthorized manner.

We reserve the right to suspend or terminate your access at any time if we determine you have violated these Terms.

5. Subscription and Payment

The Service offers a monthly subscription plan. By subscribing, you authorize recurring charges on a monthly basis until you cancel.

Payments are processed by third-party payment providers. Subscription fees are charged in advance for each billing period.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You retain access to the Service until the end of the paid period.

6. No Refund Policy

Due to the digital nature of the Service, all subscription payments are non-refundable once processed. This applies to all monthly subscription charges, including cases where you have not used the Service during the billing period or did not cancel before the renewal date.

By subscribing, you acknowledge that you are purchasing access to a digital service and that no refunds or reversals will be issued. You may cancel your subscription at any time to prevent future charges, and you will retain access until the end of the current billing period.

7. Intellectual Property

All content, design, code, and materials on the Service are owned by or licensed to the operator of Mind Vision Guard. You may not copy, distribute, modify, or create derivative works from any part of the Service without prior written permission.

8. User Content

You retain ownership of any data you submit to the Service (journal entries, emotional logs, notes). By submitting content, you grant us a limited license to store and display it solely for the purpose of providing the Service to you.

You are solely responsible for the accuracy and legality of content you submit. We do not review, endorse, or take responsibility for user content.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR TRADING LOSSES.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ukraine. Any disputes shall be resolved through negotiation or, if unsuccessful, through the competent courts of Ukraine.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via the Service or Telegram bot. Continued use of the Service after changes constitutes acceptance of the revised Terms.
