This Privacy Policy describes how Mind Vision Guard ("we", "us", "our"), available at guard.mindvision.com.ua, collects, uses, and protects your personal data. We are committed to protecting your privacy in compliance with the General Data Protection Regulation (GDPR) and the Law of Ukraine "On Personal Data Protection" (No. 2297-VI).

2. Data We Collect

We collect the following categories of personal data:

2.1 Data you provide

  • Telegram user ID, username, and display name (from Telegram authentication)
  • Journal entries, emotional state logs, and trading notes you submit
  • Subscription and payment status (no payment card details — processed by payment provider)

2.2 Data collected automatically

  • Usage data and interactions with the Service (via PostHog analytics)
  • Error reports and performance data (via Sentry)
  • IP address, browser type, device type, and operating system
  • Session duration and pages visited

3. Legal Basis for Processing (GDPR)

We process your personal data on the following legal bases:

  • Contract performance (Art. 6(1)(b) GDPR): to provide the Service you signed up for, including subscription management
  • Legitimate interests (Art. 6(1)(f) GDPR): to improve the Service, prevent fraud, and ensure security
  • Consent (Art. 6(1)(a) GDPR): for analytics cookies and non-essential tracking (see Cookie Policy)

4. How We Use Your Data

  • To authenticate you and provide access to the Service
  • To store and display your journal entries and logs
  • To manage your subscription and billing
  • To send you service notifications via Telegram bot
  • To analyze usage patterns and improve the Service
  • To detect and prevent abuse, fraud, and security incidents

5. Data Sharing and Third Parties

We do not sell your personal data. We share data only with the following service providers, and only as necessary:

  • Telegram — authentication provider; their privacy policy governs data processed within Telegram
  • PostHog — product analytics (self-hosted or PostHog Cloud); data may be processed in the EU/US
  • Sentry — error tracking; error reports including limited user context may be processed in the US
  • Payment processor — subscription billing; we do not receive or store card details
  • Hetzner (server hosting) — your data is stored on servers located in the EU (Germany)

6. Data Retention

We retain your personal data for as long as your account is active or as needed to provide the Service.

  • Account data: retained while your account exists
  • Journal entries and logs: retained until you delete them or your account
  • Analytics data: retained for up to 12 months
  • Error logs: retained for up to 90 days

Upon account deletion, your personal data is permanently deleted within 30 days, except where we are required to retain it by law.

7. Your Rights

Under GDPR and Ukrainian law, you have the following rights:

  • Access: request a copy of your personal data
  • Rectification: correct inaccurate data
  • Erasure: request deletion of your data ("right to be forgotten")
  • Restriction: request that we limit processing of your data
  • Portability: receive your data in a structured, machine-readable format
  • Objection: object to processing based on legitimate interests
  • Withdraw consent: withdraw consent at any time without affecting prior processing

8. International Transfers

Some of our third-party providers (PostHog Cloud, Sentry) may process data outside the EU/EEA. Where such transfers occur, we rely on Standard Contractual Clauses (SCCs) or other approved mechanisms to ensure adequate protection of your data.

9. Security

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, disclosure, alteration, or destruction. Data is stored on EU-based servers with restricted access.

10. Children

The Service is not intended for persons under 18 years of age. We do not knowingly collect personal data from minors. If you believe we have inadvertently collected data from a minor, contact us immediately.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes via the Service or Telegram bot. The updated policy will be posted on this page with a revised "Last updated" date.
